Terms and Conditions for All India Counseling Committee
Welcome to All India Counseling Committee, a platform providing educational counseling, guidance, profiling, and facilitation services for direct admissions to colleges and universities exclusively within India (collectively referred to as the “Services”). Our focus is solely on the Indian higher education market, assisting parents, guardians, and students in navigating legitimate admission processes, including management quota and direct admission pathways as permitted under applicable Indian laws and regulations.
These Terms and Conditions (“Terms”, “Agreement”, or “Terms of Service”) constitute a legally binding contract between you (referred to as “you”, “your”, “User”, “Client”, “Parent”, or “Guardian”) and All India Counseling Committee (referred to as “we”, “us”, “our”, “Company”, or “AICC”) regarding your access to, browsing of, and use of our website located at [www.aiccindia.com or relevant domain] (the “Website”), mobile applications (if any), booking systems, communication channels, documents, consultations, calls, emails, and any associated Services provided by us now or in the future.
BY ACCESSING, BROWSING, BOOKING ANY CONSULTATION (INCLUDING THE INITIAL FREE 11-MINUTE CALL), UPLOADING ANY DOCUMENTS, MAKING ANY PAYMENT, OR OTHERWISE USING ANY PART OF THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY, INCLUDING ALL DISCLAIMERS, LIMITATIONS OF LIABILITY, AND OTHER PROVISIONS HEREIN. IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, YOU MUST IMMEDIATELY CEASE ALL USE OF THE SERVICES AND EXIT THIS PAGE.
We strongly recommend that you print or save a copy of these Terms for your future reference, as they may be updated from time to time as described below. All Services are provided in strict compliance with Indian laws, including but not limited to the All India Council for Technical Education (AICTE) guidelines, University Grants Commission (UGC) regulations, state-specific admission policies, and prohibitions against capitation fees under relevant statutes (e.g., the Maharashtra Educational Institutions (Prohibition of Capitation Fee) Act, 1984, and equivalents in other states). We do not engage in or facilitate any unlawful practices.
Definitions and Interpretation
For the purposes of clarity and to avoid any possible misunderstanding, the following definitions shall apply throughout these Terms unless the context clearly requires otherwise:
- “Admission Facilitation” or “Direct Admission Services” means our advisory and coordination support for legitimate direct admission processes in Indian colleges and universities, including guidance on management quota seats, NRI quota (if applicable), and other non-merit-based pathways as approved by regulatory bodies like AICTE or state higher education departments. This does not include any guarantee of seat allocation.
- “Bonus Add-on Services” means those portions of the Services provided after the Initial Free Consultation and continuing up to and including the completion of student profiling and preliminary admission coordination, which are offered free of additional charge as an incentive and value-added component to Clients who proceed beyond the Initial Free Consultation.
- “Counseling and Profiling Charges” means the standalone fee of Indian Rupees Twelve Thousand Five Hundred, payable upon proceeding beyond the Initial Free Consultation, exclusively in Indian Rupees (INR) for all transactions.
- “Donations” means voluntary, post-admission contributions made by Clients directly to the admitting educational institution as a gesture of support for its infrastructure, scholarships, or development programs. Such Donations are solicited and collected solely after formal admission confirmation and are strictly non-refundable, as they constitute irrevocable gifts under Indian tax and charitable contribution laws (e.g., Income Tax Act, 1961, Section 80G where applicable). AICC facilitates the process but does not retain or control these funds; they are transferred in full to the institution.
- “Initial Free Consultation” means the complimentary telephone, video, or other electronic consultation lasting up to eleven (11) minutes provided as an introductory service.
- “Services” includes, without limitation, all consultations, advice, profiling, document reviews, recommendations, communications, materials, templates, checklists, coordination for direct admissions, and any other assistance related to college admissions exclusively in India provided by AICC.
- “Student” means the individual (typically a minor or young adult) for whom admission-related guidance is sought.
- “User Content” means any information, documents, data, text, images, audio, video, or other materials you provide to us.
Words importing the singular include the plural and vice versa; headings are for convenience only and do not affect interpretation. All references to laws, regulations, or authorities are to those applicable in India as of the Effective Date.
Acceptance of Terms
Your act of booking the Initial Free Consultation constitutes your express, affirmative, and irrevocable acceptance of these Terms. Even if you do not formally click an “I Agree” button, continued use following exposure to these Terms (via link, pop-up, footer, email, or verbal reference during consultation) creates a binding agreement.
You represent and warrant that:
(a) you are at least eighteen (18) years of age or the age of majority under Indian law;
(b) you have full legal capacity to enter into this Agreement;
(c) if acting as a parent or guardian for a Student under the age of eighteen (18) years, you have all necessary authority and consent to bind the Student and share their personal data in compliance with the Juvenile Justice (Care and Protection of Children) Act, 2015, and related laws;
(d) all information you provide is true, accurate, current, and complete, and you have obtained all requisite consents for sharing Student data.
Description of Services
All India Counseling Committee is not a college, university, testing agency, or government counseling body. We are an independent educational advisory service focused exclusively on the Indian market, helping parents navigate legitimate admission processes for undergraduate and postgraduate programs in recognized Indian institutions.
Services may include, but are expressly not limited to:
- Preliminary discussion during the Initial Free Consultation (strictly limited to eleven (11) minutes unless extended at our sole discretion);
- Detailed one-on-one counseling sessions (paid);
- Creation and refinement of a comprehensive Student profile;
- Guidance on document collection, organization, and presentation in accordance with institutional requirements;
- Recommendations regarding suitable institutions across India, including state universities, deemed universities, and private colleges with approved direct admission quotas;
- Strategic advice on application timelines, eligibility criteria under AICTE/UGC norms, entrance exam waivers (where applicable), and preparation for any required institutional interviews or assessments;
- Coordination and facilitation for direct admission processes, such as submitting applications for management quota seats through official institutional portals or designated channels, ensuring full compliance with fee structures and reservation policies;
- Post-admission support, including guidance on enrollment formalities and, where opted by the Client, facilitation of Donations to the admitting institution as a voluntary contribution.
Important Repeated Disclaimer: All Services are advisory and facilitative only. We operate within the framework of Indian laws prohibiting capitation fees and guaranteeing transparency in admissions (e.g., under the Right to Education Act, 2009, and state anti-capitation statutes). Direct admissions are handled through legitimate, regulated pathways, and AICC bears no responsibility for final seat allocation, which rests solely with the educational institution and relevant authorities. Post-admission Donations are entirely optional, initiated only after written admission confirmation from the institution, and serve as non-refundable philanthropic support to the college’s developmental initiatives. AICC does not guarantee eligibility for Donations or their tax benefits.
All post-Initial Free Consultation support up through completion of the Student profile and preliminary admission coordination is provided as Bonus Add-on Services at no additional fee beyond the Counseling and Profiling Charges. This structure exists to encourage thorough preparation before any decision to pursue full Admission Facilitation.
Eligibility and User Obligations
You agree at all times to:
- Provide truthful, complete, and timely information and documents, including proof of eligibility for direct admission categories;
- Notify us immediately of any changes to provided information;
- Comply with all applicable Indian laws, including anti-plagiarism rules of universities, the Information Technology Act, 2000, and state admission regulations;
- Not engage in any form of academic dishonesty or unlawful inducement (we will terminate Services immediately and without refund if we reasonably suspect such conduct, and report to authorities if required);
- Not hold us responsible for outcomes determined solely by third parties (colleges, AICTE, state counseling bodies, etc.);
- Cooperate fully, respond promptly to requests, and meet agreed deadlines, including institutional submission timelines;
- Refrain from recording consultations without our prior written consent, in line with privacy norms under the Digital Personal Data Protection Act, 2023;
- Use Services only for lawful, personal, non-commercial purposes related to the Student’s education in India;
- Acknowledge that any Donations are voluntary post-admission contributions to the institution, facilitated by AICC for convenience, but executed as direct transfers with no involvement or liability on our part beyond administrative coordination.
We reserve the right (but have no obligation) to refuse, suspend, or terminate Services to any person at our sole discretion, including (without limitation) for suspected fraud, misrepresentation, abusive behavior, non-payment, ineligibility under reservation quotas, or breach of these Terms. All decisions regarding admission facilitation are subject to institutional approval and regulatory compliance.
Fees, Billing, and Payment Terms
5.1 Initial Free Consultation
No charge applies for the first eleven (11) minutes. Any extension beyond this is at our discretion and incur charges.
5.2 Counseling and Profiling Charges
Upon your decision to proceed after the Initial Free Consultation, the non-refundable fee of INR 12,500 becomes immediately due and payable. This covers all Bonus Add-on Services up to profile completion and preliminary admission coordination.
5.3 Direct Admission Facilitation Fees
Custom pricing is quoted case-by-case after detailed discussion of scope, number of applications, institutional preferences, and complexity. Quotes are valid for a limited period (usually 7–14 days) and subject to acceptance. All fees are for our advisory and coordination services only.
5.4 Donations
Donations are solicited exclusively after the Student receives and accepts a formal admission offer from the institution. They are calculated based on the institution’s published guidelines for voluntary contributions (e.g., for infrastructure or endowment funds) and are fully non-refundable once transferred. AICC facilitates the payment process via secure channels but does not set Donation amounts or retain any portion thereof—the full amount goes directly to the institution. Clients opting for this must provide explicit written consent confirming the voluntary and irrevocable nature of the Donation. Tax receipts, if applicable, are issued by the institution.
5.5 Payment Mechanics
- All payments (fees and facilitated Donations) are processed via secure third-party gateways compliant with RBI guidelines (e.g., UPI, net banking, cards).
- Fees exclude applicable taxes (GST at prevailing rates). Donations may qualify for tax deductions under Section 80G if the institution is registered.
- Late payments accrue interest at 4.5% per month or the maximum legal rate under the Indian Contract Act, 1872.
- All transactions are in INR only.
5.6 Incidental Costs
You remain solely responsible for all third-party fees (application fees, courier, translation, entrance exams, travel, etc.), as well as any institutional tuition or other mandatory charges.
Refund and Cancellation Policy
Refunds are extremely limited due to the highly personalized, time-sensitive, and non-replicable nature of the Services, in line with consumer protection norms under the Consumer Protection Act, 2019:
- Initial Free Consultation: No refund possible (it is free).
- Counseling and Profiling Charges: 100% non-refundable once paid and Services have commenced (which occurs immediately upon payment).
- Direct Admission Facilitation Fees:
- Full refund (minus INR 2,500 administrative fee) only if canceled in writing within twenty-four (24) hours of payment and before we begin substantive work.
- No refunds whatsoever after: (i) profile delivery, (ii) institutional shortlist provided, (iii) any application materials reviewed or submitted, (iv) any coordination session held, or (v) thirty (30) days from payment (whichever occurs first).
- Donations: Strictly 100% non-refundable at all times, as they are voluntary, irrevocable contributions to the institution post-admission, akin to charitable gifts under Indian law. No exceptions, even in cases of subsequent withdrawal from the program by the Student.
- Bonus Add-on Services: Non-refundable by definition (they are free).
- Refunds (when exceptionally granted) processed to original payment method within thirty (30) to forty-five (45) business days, subject to bank processing times.
- Chargebacks or disputes filed without following this policy may result in immediate termination, reporting to payment processors, and legal action for recovery.
No Guarantees / Results Disclaimer
WE REPEAT FOR EMPHASIS:
All India Counseling Committee provides advisory and facilitative guidance only. We do not, under any circumstances:
- Guarantee, promise, or warrant admission to any college, university, program, or course, including under direct or management quota pathways;
- Guarantee eligibility for Donations, their acceptance by institutions, or any associated benefits;
- Influence or contact admissions authorities on your behalf beyond standard coordination;
- Engage in or facilitate capitation fees, unlawful payments, or any practices prohibited under AICTE/UGC guidelines or state laws;
- Override institutional policies, merit criteria, reservation rules, or regulatory approvals.
Admissions decisions and Donation solicitations are made solely by educational institutions based on criteria that change frequently and are outside our control. External factors (economic conditions, policy shifts by state governments, competition levels, regulatory audits, etc.) further reduce predictability. All Services are on a best-effort basis, with full transparency and compliance as our core commitment.
Intellectual Property
All materials, templates, checklists, frameworks, session notes (excluding your own documents), website content, logos, and proprietary methodologies remain the exclusive property of All India Counseling Committee, protected under the Copyright Act, 1957, and other Indian intellectual property laws. You are granted a limited, revocable, non-transferable, non-sublicensable license to use provided materials solely for the Student’s personal admission process during the active engagement period.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our materials without express written permission.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL INDIA COUNSELING COMMITTEE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, COUNSELORS, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATING TO:
- Use of or inability to use the Services;
- Any admission decision, rejection, seat cancellation, or financial outcome;
- Loss of data, documents, opportunities, or time;
- Delays, interruptions, or errors in communication or institutional processes;
- Third-party actions or omissions, including by colleges or regulatory bodies;
- Any advice or information provided (even if we were advised of the possibility of such damages);
- Handling or facilitation of Donations, including any disputes with institutions.
In no event shall our total aggregate liability exceed the total fees actually paid by you to us (excluding Donations) in the twelve (12) months preceding the claim, as limited under the Indian Contract Act, 1872, and Limitation Act, 1963.
Indemnification
You agree to indemnify, defend, and hold harmless All India Counseling Committee and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, misuse of Services, provision of false information, infringement of third-party rights, violation of Indian law, or any issues related to post-admission Donations.
Termination – Multiple Scenarios
We may suspend or terminate your access immediately and without notice/refund if we believe (in our sole discretion) that you have breached any provision, engaged in unlawful activity (e.g., attempting capitation-like arrangements), failed to pay, or if continuation would expose us to liability under Indian regulations.
You may terminate by written notice, subject always to the refund policy above. Upon termination, all licenses cease, and you must destroy/delete our materials.
Force Majeure
Neither party shall be liable for delay or failure caused by events beyond reasonable control, including (but not limited to) acts of God, pandemics (e.g., as under the Epidemic Diseases Act, 1897), government orders, internet outages, strikes, supply chain disruptions, or natural disasters, as recognized under Indian contract law.
Governing Law, Jurisdiction, and Dispute Resolution
These Terms are governed exclusively by the laws of India, including the Indian Contract Act, 1872, Consumer Protection Act, 2019, and Information Technology Act, 2000, without regard to conflict-of-laws principles.
Exclusive jurisdiction lies with the competent courts in Ahmedabad, Gujarat, India. Disputes shall first attempt informal resolution via email, failing which, resolution through mediation under the Commercial Courts Act, 2015, or arbitration under the Arbitration and Conciliation Act, 1996, in Ahmedabad, India, may apply as mutually agreed.
You waive any objection to venue or inconvenient forum.
Miscellaneous Provisions

- Severability: If any provision is held invalid or unenforceable by an Indian court, the remainder shall continue in full force.
